What is a belated return?
A belated return is an income tax return filed after the original due date (usually 31 July for non-audit taxpayers) but before the belated-return deadline of 31 December of the assessment year. It is filed under section 139(4) and is treated as a valid return.
After 31 December, a normal belated return is no longer possible — the only route left is an updated return (ITR-U), which costs significantly more in additional tax.
What a belated return actually costs you
- Late fee under section 234F — up to ₹5,000 (₹1,000 if total income is up to ₹5 lakh)
- Interest under section 234A at 1% per month on any unpaid tax
- Interest under sections 234B and 234C where advance tax was short
- Business and capital losses (other than house property loss) cannot be carried forward
- Refunds are delayed, and interest on your refund is reduced
How to file a belated return
- 01Collect your documents
Form 16, AIS and Form 26AS, bank interest statements, capital gains statements and proof of any deductions.
