What your employer will actually accept
A rent receipt needs the tenant's name, the landlord's name and address, the rented property address, the amount, the period covered, the mode of payment and the landlord's signature. Where annual rent exceeds ₹1,00,000, the landlord's PAN is mandatory.
A revenue stamp is customarily affixed on cash receipts above ₹5,000. Most employers now prefer bank transfer proof alongside the receipts, because a matching bank debit is far harder to dispute than a signature.
Paying rent to a family member
It is legal to claim HRA on rent paid to a parent or spouse's parent, provided the property is genuinely owned by them, the rent is actually transferred by bank, and the recipient declares the rental income in their return.
What fails on scrutiny is the paper-only arrangement: no bank trail, rent that suspiciously matches the exemption cap, and a landlord who never declared the income. If your claim is large, have a chartered accountant sanity-check the documentation before you file.
Frequently asked questions
Do I need the landlord's PAN?
Only if annual rent exceeds ₹1,00,000. If the landlord refuses to share it, you must file a declaration with your employer, and the claim becomes harder to defend.
Can I claim HRA without rent receipts?
Employers require receipts to allow the exemption in Form 16. You can still claim it while filing your return if you can substantiate payment, but you should expect to be asked for proof.
Is a revenue stamp required?
Customarily, for cash receipts above ₹5,000. Receipts against bank transfers do not need one.
